\1 classes:

A1 for diplomats.

B1 (business), B2 (tourist) multi-entry visa (6mo+6mo) but is limited by I-90 at entry. Tourist: employment not permitted. Student: for certain school. Investor: certain industry.

NB: If intention is to find a school then the legend "Prospective student/school not chosen" should be sought on B2 visa or there may be difficulty to change later.

Employment: Employment is usually unauthorized for a B type visa. Those permitted to work are issued an employment authorization.

E1 Treaty trader and Treaty investor are for those who wish to reside for the purpose of business trading, investing or development.

F1 Full time course of study at accredited institution (visa good for duration of study). Prospective student must submit form I-20A-B and OF-156.

H1-A Professional nurse (5-6 yrs, must pass CGFNS test). H1-B Prof specialty occupations (BA or higher) 3-10 yrs.

H2-A Seasonal agricultural work. H2-B For defined specialized temporary work (1 year). H3 Approved training (2 years).

I for news media.

J1 On the job training (12-18 mths). Employmnt OK. J2 To accompany the J1 visa holder, employment permitted.

K1 Fiancee for those intending to marry (90 days).

L Intra-company transferee (3-7 years).

O1 Aliens of extraordinary ability, 3 years. O2 for aides of O1 visas.

P1 for intl recognized athletes and entertainers. P2 for artists and entertainers in reciprocal exchange or participating in unique program.

R for religious workers or participants.


\2 Immigrant Visas are permanent visas (green cards) are those granted according to a formula and quota depending on personal and world situation. They permit the owner to work and live wherever he wishes. They are of two classes:

Family based: Spouses, relatives, and widows (married 2 years) of Americans, unmarried children over 21, married sons or daughters. Some refugees and those seeking asylum.

Employment based: there are five preference grades in this catagory.

Two categories: PREFERENCE and NON-PREFERENCE IMMIGRANTS. The first is from a quota and the second is non quota as immediate family, refugees, employment, investor, diplomatic, etc.

INTENT: INS can assume and construe that the absence of an alien with a permanent visa residing outside of the U.S. for an extended period (one year) to be abandoning his right to his permanent visa.


\3 Non-Immigrant Visas Unlimited amount, usually no quotas (except H1-B, 65,000).

Requirements: Permanent domicile, employment, finances, marriage. Show an improbable intention to remain in the U.S. as a family with unaccompanied children, multi-visit tourist to other countries, etc.

INTENT: It cannot be the intent of an applicant of a non-immigrant temporary visa to permanently reside in the U.S.

You most probably cannot visit the U.S. while your preference is pending.

Exclusions: Of five grounds for exclusion to entry, all are related to crime or incarceration for drugs or moral turpitude.

Anyone previously excluded or deported is excluded 1-20 years.

Canadians: and some Mexicans have special advantages, some due to The Free Trade Agreement of 1/01/89.


\4 Immigration is migration and a request to enter a country. In this country the INS has some discretion to grant or deny access.

If you marry an American, you are entitled priority to permanent resident status unless: You are an illegal alien. Your status as a student tourist, or business person expired. You worked without authorization. Your priority is not current.

An Amerasian is a person with an American father born after 12/31/50 and before 10/22/82 in Vietnam, Korea, Laos, Cambodia, or Thailand. The Amerasian must have a sponsor (or group) who is an American (or resident) over 21 and provide for his needs in the U.S. Use form I-360.

A physician requesting an entry visa must pass an English proficiency exam and one of two national medical exams. Application: $95. Two test: Oral 2X, written $30: 20 ques 2 tries.


\5 marry

Easier to go to fiancee's country and marry.

Immigration form I-130, petition for alien relative.

Form I-134, affidavit of support. Bank statements of petitioner. Employment certification of petitioner. Documentation of petitioner finances. Form G-325A biographic information. Separate color photos of both. Proof of citizenship. Proof of previous marriage terminated. Circumstances of meeting and marriage. Proof of intent to marry within 90 days. Filing fee of $75. All documents to INS nearest petitioner. File form I-485, adjustment status after marriage (valid for 2 yrs).

You must marry within 90 days (or face deportation), or marry someone else, you (and those with you) lose right to green card and must go through consular proceedings.


\6 Annual DIVERSITY Immigrant Visa (DV) lottery program. Requirements: HS diploma or two years work experience.

If you win the lottery, you must pay a $25 filing fee to the American Consulate. Have a firm offer of employment for at least a year.

Only one application may be submitted per adult and spouse.

All applicant's will be advised of their registration and the winning visas will be issued from 10/01/95 through 9/30/96.
